Affiliate Program Terms

ALOHA LIFE LETTERS LLC

Thank you for your interest in sharing Aloha Life Letters with others. If and when our Affiliate Program is open, these terms describe how it works and what we ask of our Affiliates. They apply in addition to our Terms & Conditions and the rest of our legal suite.

1. About the Program

Our Affiliate Program allows approved participants ("Affiliates") to earn a commission by referring Customers to Aloha Life Letters via a unique link or code. Participation is by approval, and these terms apply in addition to our Terms & Conditions. The Affiliate Program may not be available at all times, and we may open, pause, or close it at our discretion.

Program-specific details, including commission rates, cookie duration, payout schedules, minimum payout thresholds, and approved promotional materials, will be provided when an Affiliate is accepted into the program and may change from time to time.

2. Joining

To become an Affiliate, you must apply and be approved. You must be at least 18, provide accurate information, and have a platform or audience consistent with our brand values. We may accept or decline any application at our discretion.

3. Commissions and Payment

Approved Affiliates earn a commission on qualifying sales made through their tracked link or code, at the rate and on the terms stated when you join. Payment schedules, minimum payout thresholds, and payment methods will be described in your program details, and we may adjust commission rates and terms with notice.

Commissions are not earned on:

• Refunded or canceled Orders

• Orders subject to a chargeback

• Fraudulent Orders

• Self-purchases, unless expressly allowed

• Purchases made before someone clicked your Affiliate link

• Purchases made outside the cookie attribution period, where one applies

In the event of a dispute over whether a sale qualifies, our tracking records take precedence.

4. Taxes

Affiliates are responsible for their own taxes and for reporting their own income. Where required by law, you must provide any tax forms we need before we can pay you, such as a Form W-9 or other applicable documentation.

5. Disclosures and How Affiliates Must Promote Us

We ask that you represent Aloha Life Letters honestly and kindly. You are responsible for making clear and conspicuous disclosures of the Affiliate relationship whenever required by law, including the U.S. Federal Trade Commission (FTC) endorsement guidelines or similar laws in other jurisdictions. Affiliates also agree to:

• Make only truthful, accurate claims about our products and offerings

• Use only the images, Artwork, and marketing materials we provide or approve, respecting our Artwork & Copyright Policy

• Follow our brand guidelines and represent us in a positive, respectful way

• Comply with all applicable laws, including advertising, email, and privacy laws

6. What Affiliates May Not Do

• Send spam or unsolicited messages, or make misleading claims

• Bid on our brand names or trademarks in paid search, or register confusingly similar or misleading domain names

• Purchase products through your own Affiliate links unless expressly permitted

• Create fake reviews or testimonials

• Impersonate Aloha Life Letters, or create social media accounts or websites that appear to be official Aloha Life Letters accounts

• Use cookie stuffing or any similar tracking manipulation

• Interfere with another Affiliate’s referrals

• Offer unauthorized coupons, or generate self-referrals, fake Orders, or fraudulent clicks

• Imply a partnership, sponsorship, or endorsement beyond the Affiliate relationship

7. Brand and Reputation Protection

To protect our creative work and our brand, Affiliates may not modify our logos, alter our approved marketing materials, create derivative branding, or use our Artwork beyond the permissions we expressly grant. Please see our Artwork & Copyright Policy and Copyright & Legal Permissions for what is and is not allowed.

Because Affiliates help represent Aloha Life Letters, we also reserve the right to reject, suspend, or terminate any Affiliate whose website, social media accounts, promotional methods, or other activities we reasonably believe conflict with the values or reputation of Aloha Life Letters; promote unlawful, deceptive, hateful, discriminatory, violent, sexually explicit, or otherwise inappropriate content; or otherwise create a material risk to our brand or our Customers. This determination is made at our reasonable discretion, and our aim is simply to ensure Aloha Life Letters is represented in a way that reflects our mission, values, and community standards.

8. Intellectual Property License

We grant Affiliates a limited, non-exclusive, revocable, non-transferable, and non-sublicensable license to use our approved names, logos, and marketing materials solely to promote Aloha Life Letters under these terms. This license is valid only while you are actively participating in the Affiliate Program. All intellectual property rights remain with Aloha Life Letters LLC. Upon termination, you must immediately stop using all Affiliate materials, links, logos, and other approved promotional assets.

9. Reservation of Rights

We may modify, suspend, pause, or discontinue the Affiliate Program, its commission structure, promotional materials, or eligibility requirements at any time, with reasonable notice where practical. Participation does not create any vested right to continued participation in the program.

10. Termination

Either of us may end the Affiliate relationship at any time. We may suspend or terminate an Affiliate for violations of these terms, fraud, abuse, copyright infringement, deceptive marketing, inactivity, or conduct harmful to the Aloha Life Letters brand. Commissions resulting from fraud or violations of these terms may be withheld or forfeited at our reasonable discretion. On termination, you must stop using our materials and links, and any unpaid, properly earned commissions on valid sales will be paid according to the normal schedule.

Inactivity. We may also close an Affiliate account that has generated no qualifying referrals or sales for twelve (12) consecutive months. Where practical, we will attempt to notify you at the email address on file before closing an inactive account. You are welcome to reapply when you are ready to promote us again.

11. Independent Contractor Status

Affiliates are independent contractors. Participation in the Affiliate Program does not create any employment, partnership, joint venture, agency, franchise, or exclusive relationship between you and Aloha Life Letters LLC.

12. Limitation of Liability

We are not responsible for technical failures, tracking interruptions, platform or website outages, payment processor issues, or delays outside our reasonable control that may affect referrals, tracking, or payments. This section works alongside the broader limitations in our Terms & Conditions. Because referral tracking depends on cookies and third-party systems, we cannot guarantee that every referral will be tracked, and we are not responsible for untracked or unattributed referrals caused by cookie blockers, cleared browser cache or cookies, private or incognito browsing, or a visitor's device or browser settings.

13. Related Policies

These terms work together with our Terms & Conditions, Acceptable Use Policy, Artwork & Copyright Policy, Copyright & Legal Permissions, and Privacy Policy, which also apply to your participation.
